Globee® Awards Talent Release Agreement
Effective date: August 13, 2026
This Talent Release Agreement (“Agreement”) is between Silicon Valley Communications, LLC, doing business as Globee® Awards (“Globee® Awards” or “Producer”), and the individual who accepts this Agreement through an online form (“Participant”).
The Participant is identified by the information submitted with the applicable interview, recording, event, photography, or production form. By selecting the acceptance checkbox and submitting the form, Participant confirms that Participant has read, understood, and agreed to this Agreement. The electronic acceptance record—including the submitted name, email address, date, time, and related production information—forms part of this Agreement.
1. Participation and Recording Consent
Participant voluntarily agrees to be interviewed, photographed, filmed, recorded, quoted, or otherwise included in the program, interview, event, or production identified above (the “Production”).
Participant authorizes Producer and its employees, contractors, production providers, publishers, distributors, service providers, successors, and assigns to capture and use Participant’s:
name, professional title, organization, biography, and approved factual background;
image, likeness, appearance, performance, gestures, and voice;
interview responses, quotations, stories, and other contributions; and
photographs, recordings, slides, graphics, logos, clips, documents, or other materials Participant provides for the Production (“Participant Materials”).
2. Rights Granted
Participant grants Producer a worldwide, perpetual, nonexclusive, royalty-free right and license to record, edit, excerpt, caption, translate, adapt, reproduce, publish, display, perform, transmit, distribute, archive, advertise, and promote the Production and Participant Materials, in whole or in part, in any media or format now known or later developed.
Authorized uses may include Globee® Awards websites, digital publications, video, audio, podcasts, livestreams, social media, email, press materials, promotional materials, compilations, excerpts, archives, presentations, and future programs relating to Globee® Awards and its editorial or recognition activities.
Producer may authorize production, hosting, editing, publishing, distribution, marketing, analytics, archiving, and other service providers to exercise these rights as reasonably necessary for the authorized uses.
Participant retains ownership of Participant’s preexisting original materials. Except for the rights granted in this Agreement, Producer does not acquire ownership of Participant’s underlying intellectual property merely because it is provided for the Production.
3. Editing and Editorial Control
Producer may edit, arrange, combine, excerpt, caption, title, format, translate, or adapt the Production for length, clarity, style, accessibility, accuracy, legal risk, technical requirements, and different distribution channels.
Producer will not knowingly create a materially false statement attributed to Participant. Subject to that limitation, Participant waives any right to inspect or approve the final edit, headline, layout, caption, context, publication date, distribution channel, promotional excerpt, or accompanying material unless Producer separately agrees in writing.
4. No Obligation to Publish
Producer has no obligation to record, complete, publish, distribute, promote, or continue making the Production available. Producer may postpone, edit, decline, archive, restrict, or remove the Production at its editorial discretion, subject to applicable law and existing distribution commitments.
5. No Compensation
Participant understands that participation is voluntary. Unless a separate written agreement authorized by Producer states otherwise, Participant will not receive compensation, royalties, residuals, license fees, revenue sharing, or any other payment for participation or the authorized uses.
Participant is responsible for personal travel, lodging, preparation, wardrobe, connectivity, and other expenses unless Producer separately agrees in writing to pay or reimburse a specific expense.
Participation does not guarantee an award, editorial coverage beyond the Production, publicity, audience reach, business opportunities, employment, professional advancement, immigration benefits, or any other outcome.
6. Participant Representations
Participant represents that:
Participant is at least 18 years old and has legal capacity to enter this Agreement;
Participant’s statements will be truthful to the best of Participant’s knowledge and not knowingly defamatory or materially misleading;
Participant has authority to participate and has obtained any employer, client, organization, privacy, publicity, or other approval required;
Participant owns the Participant Materials or has sufficient permission to grant the rights in this Agreement;
authorized use of the Participant Materials will not knowingly infringe copyright, trademark, privacy, publicity, confidentiality, contractual, or other third-party rights; and
Participant will not disclose trade secrets, NDA-protected information, unlawfully obtained material, or unnecessary sensitive personal information.
Participant must identify any third-party material and any limitations on its use before recording or delivery. Producer may decline or remove material if ownership or permission cannot be reasonably verified.
7. Names, Logos, and Biographical Information
Participant authorizes Producer to identify Participant by the professional or public name, organization, title, biography, and other information supplied or approved by Participant. Participant authorizes reasonable use of an organization name or logo included in authorized Participant Materials, but does not grant rights beyond those Participant has authority to grant.
Participant will promptly notify Producer of a verifiable factual error. Producer may correct factual or typographical errors but is not required to make subjective, promotional, or editorial changes after publication.
8. Release of Claims
To the extent permitted by law, Participant releases Producer and its employees, contractors, production providers, publishers, distributors, successors, and assigns from claims arising from the authorized recording, editing, publication, distribution, promotion, or use of the Production, including claims based on right of publicity, use of likeness or voice, privacy, or editorial alteration consistent with this Agreement.
This release does not apply to uses outside the rights granted by this Agreement or to liability that cannot lawfully be waived, including fraud, willful misconduct, or gross negligence to the extent applicable law prohibits waiver.
9. Responsibility for Participant Materials
Participant is responsible for third-party claims, damages, and reasonable costs arising from Participant’s material breach of the representations concerning authority, ownership, permissions, confidentiality, privacy, or legality of Participant Materials. Producer will provide reasonable notice of a covered claim and permit reasonable participation in the defense or resolution.
This section does not require Participant to indemnify Producer for unauthorized uses or alterations made solely by Producer or for Producer’s own unlawful conduct.
10. Privacy
Producer handles personal information under the Globee® Awards Privacy Policy. Participant understands that the authorized Production is intended for public use and may include the identifying information described in this Agreement.
Once material is publicly distributed, copies may remain in search results, caches, archives, social-media posts, downloads, broadcasts, publications, or third-party channels beyond Producer’s control.
11. No Employment or Agency
This Agreement does not create employment, agency, partnership, joint venture, fiduciary, sponsorship, or endorsement status. Participant is not authorized to act for or bind Producer.
12. Governing Law and Venue
This Agreement is governed by California law, without regard to conflict-of-laws principles. Any proceeding arising from this Agreement must be brought in a state or federal court located in Santa Clara County, California, unless applicable law requires otherwise. Each party consents to those courts.
Before filing a claim, the parties should attempt in good faith to resolve the matter through written notice. Nothing prevents urgent injunctive relief or use of a small-claims procedure where legally available.
13. General Terms
This Agreement is the complete agreement concerning the Production and supersedes prior oral or written discussions on the same subject. An amendment must be recorded electronically or in writing and accepted by both parties.
If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. Participant may not transfer this Agreement without Producer’s written approval. Producer may assign the Agreement with the Production or in connection with a lawful reorganization, merger, acquisition, or transfer of the applicable business.
Electronic acceptance, electronic signatures, and electronic records have the same effect as acceptance on paper to the extent permitted by applicable law.
14. Electronic Acceptance
By selecting the required checkbox and submitting the applicable online form, Participant confirms that Participant:
has read and understands this Agreement;
has had an opportunity to ask questions and seek independent advice;
is at least 18 years old and has authority to accept this Agreement;
voluntarily agrees to the recording and authorized uses described above; and
understands that the submitted form and acceptance record constitute evidence of agreement.
The checkbox must not be preselected. If Participant does not agree, Participant must not submit the form or participate in the Production.
Recommended Checkbox Language
I am at least 18 years old. I have read and agree to the Globee® Awards Talent Release Agreement and authorize the recording and use of my name, image, likeness, voice, interview, biography, and materials as described in that agreement.
Globee® Awards should retain the version of this Agreement accepted, Participant’s submitted name and email address, the date and time of acceptance, the associated form or production record, and other electronic evidence reasonably maintained by the form system.
